Situational Analysis of Children in the Justice System (Justice Sitan) in Kenya

The Ministry of Justice National Cohesion and Constitutional Affairs (MOJCA) and the United Nations Children Fund (UNICEF) are seeking the Expression of Interest of a consultancy firm and/or organization to conduct a Situational Analysis of Children in the Justice System (Justice Sitan) in Kenya.

Scope of Work

This Justice Sitan will provide:

1. qualitative and quantitative information on the ability of the current formal system of justice and related services to deliver justice to children in accordance with international and national guidelines, regulations, and statutes; and,
2. an overview of what informal mechanisms exist and whether these mechanisms operate in a complementary manner to the formal system or as a barrier to seeking and receiving justice.
   

The report will map the system of justice, identify gaps in service delivery, and make recommendations as to how to improve children's access to justice and their treatment within the system as victim, witness, alleged offender, committed offender, or any other reason for which the child may be in the justice system.

The report will also look at the gender dimensions of the justice system from both the service provider and client perspective and at the demographic and socio-economic background of the children and their families.

The deliverables include:

• Quantitative and Qualitative Interview Assessment tools
• Report of the literature review
• Quantitative data set and assessment report
• Draft Assessment report
• Final Report
• Presentation of the findings to the MOJCA and UNICEF KCO team (and possibly other interested parties)

Requirements

• Only those firms/organizations which satisfy the following requirements will be considered as potential consultancy firms:
• Proven professional experience in the legal and judicial fields (minimum of 10 years)
• Proven knowledge of justice systems and treatment of children
• Extensive experience in assessment design, qualitative and quantitative data analysis (remaining cognizant of gender dimensions), including use of statistical programmes
• Proven research and analytical skills
• Experience working in Africa (and Kenya) an advantage
• Excellent writing skills (Candidates will be required to show examples of previous written work).
• Fluency in written and spoken English and fluency in spoken Swahili.

Time frame: 6 months

Only short-listed firms from this Expression of Interest will be invited to submit comprehensive project proposal and bid.

Consultancy to review, and Amendments, to the NGO legal frame-work NGOs Co-Ordination Act No. 19 of 1990 NGOs Co-ordination Board

Background

The NGOs Co-ordination Board (hereinafter referred to as "the Board") is a State Corporation established under the NGOs Co-ordination Act and mandated to inter alia register, co-ordinate and facilitate the work of all national and international NGOs operating in Kenya.

The Board is in the process of undertaking a comprehensive review of the NGOs Co-ordination Act No. 19 of 1990 and the NGOs Co-ordination Regulations of 1992 as per the provisions of the Sessional Paper No. 1 Of 2006.

The Board therefore seeks services of an independent consultant to develop a framework and produce a Draft Bill.

Objective

The objective of the consultancy is to develop a robust legal and regulatory framework that will promote efficiency and effectiveness of the NGO Sector in Kenya.

The framework will facilitate and support the basis for participatory monitoring of the sector and ensure freedom of association, integrity and good governance, compliance, accountability and transparency.

The Board invites bids from eligible consultants to submit their proposal to carry out this assignment.

Interested consultants must have carried out similar assignments for other reputable organisations.

Background and Objective

The National Legal Aid (and Awareness) Pilot Programme (NALEAP) was launched on 18th September 2008. NALEAP's broad objective is to improve access to justice in Kenya, especially among the poor, the marginalized and the vulnerable in society.

The NALEAP Steering Committee appointed by the president on 30th November 2007 is composed of representatives from the Ministry of Justice, National Cohesion and Constitutional Affairs, the Judiciary, State Law Office,The Kenya National Commission on Human Rights, Police Department, Prisons Department, Children Services Department, Probation and After Care Services, faculties of law of public universities, the Law Society of Kenya, Federation of Women Lawyers (FIDA) Kenya, International Commission of Jurists (ICJ) Kenya and the Kenya Network of Paralegal Workers.

NALEAP seeks to advance its mandate of enhancing access to justice through creating legal awareness in the country and promoting the use of Alternative Dispute Resolution (ADR) methods, among other strategies.

The Ministry requests for proposals for consultancy services for;

• Development of a Strategic Plan for the National legal Aid and Awareness Programme
• Development of a National Legal Awareness Strategy
• Development of a training of trainers' manual on Alternative Dispute Resolution (ADR)

Tasks and Scope of the Consultancy for Development of a National Legal Aid and Awareness Strategy Plan 2009/2012

The consultant will facilitate and provide overall guidance in the development of the programme's Strategic Plan incorporating a Monitoring and Evaluation system, schedules, logical framework, implementation plan and budget projections.

Consultants Qualifications and Specifications

The consultant should have appropriate skills, knowledge and experience in development of institutional strategic Plans. Specifically, only persons with these qualifications will be considered:

• At least 5 years experience in strategic planning, management, budgeting, and expertise in monitoring and evaluation.
• A relevant advanced degree in social sciences from a recognized university.
• Previous experience or involvement in public policy formulation processes. Experience in current legal and governance reforms would be an added advantage,
• Excellent communication and writing skills.
• Demonstrated ability to work under pressure and meet strict deadlines
• Availability for the entire period of the consultancy.

In addition, the consultant should provide proof of tangible evidence of at least three institutional strategic plans he/she has prepared.

TASKS AND SCOPE OF THE CONSULTANCY FOR DEVELOPMENT OF A NATIONAL LEGAL AWARENESS STRATEGY

The consultant will facilitate the development of a national legal awareness strategy, incorporating the participation of GoK departments and agencies, the Law Society of Kenya, Civil Society Organizations, the private sector, the media and members of the public.This consultancy is for a period of one month.

Qualifications

1. A relevant advanced degree in social sciences from a recognized university.
2. Proven experience or involvement in public communication and awareness creation processes.
3. Knowledge on current legal and governance reforms would be an added advantage.
4. Excellent communication and writing skills.
5. Demonstrated ability to work under pressure and meet strict deadlines
6. Availability for the entire period of the consultancy.

Tasks and Scope of the Consultancy for Development of a Training of Trainers’ manual on Alternative Dispute Resolution

The consultant will develop a Training of Trainers' manual on Alternative Dispute Resolution suitable for use by the National Legal Aid and Awareness Programme.

Qualifications of the Consultant(s)

The Consultant interested in this assignment should possess the following minimum qualifications:

• A graduate degree in law
• Competence in the application of the Civil Procedure Rules (CAP) 21 Laws of Kenya
• At least 10 years experience in legal practice.
• Training of trainer's certificate in ADR from a recognized institution.
• At least 5 years experience in ADR practice.
• Strong communication skills (oral, written and presentation skills among others).

Interested applicants are expected to put through their responses in not more than 5 pages indicating how they intend to carry out the assignment.

The response should be accompanied with:

1. Detailed CV of the consultant/profile of the firm with C.Vs of the professionals indicating educational background, relevant qualifications and experience;
2. At least two recently completed assignments/projects similar in nature to the proposed task together with the postal, email and telephone addresses of the respective clients;
3. A proposed approach and methodology for the research, including timeline and (negotiable) budget.
4. Copies of registration certificate, PIN, VAT and tax compliance certificates.
